Brief History of the Act

The Hon’ble Supreme Court in Bennett Coleman v. Union of India (AIR 1973 SC 106) has held for the first time that the right to freedom of speech and expression guaranteed by Art.19(1)(a) of the Constitution of India included Right to Information. Subsequently the said dictum evolved into a statute in the year 2005 enactment of the Right to Information Act. The preamble of the Act states as under:

“ An Act to provide for setting out the practical regime of right to information for citizens to secure access to information under the control of public authorities, in order to promote transparency and accountability in the working of every public authority, the constitution of a Central Information commission and State information commissions and for matters connected therewith or incidental thereto.”

How to apply for information under the RTI Act?
An application seeking information can be sought only by Citizens of India. The request for obtaining information shall comply to Section 6 of the Act wherein it is mentioned that the request shall be in writing or through electronic means in English or Hindi or in the official language of the area in which the application is being made, accompanying such fee as applicable under the statute to the public information officer of the public authority specifying the particulars of the information sought by the applicant.

The applicant has to comply with the following
a) To disclose the citizen status along with the application.
b) The request for information is to be in writing.
c) The application should contain the contact details (postal address, telephone number, fax number, email address) for furnishing the reply.

RTI Application – How to send?
As per the Right to Information (Regulation of Fee and Cost) Rules, 2005, a request for obtaining information under the Act shall be accompanied by an application fee of Rupees Ten (Rs. 10) by way of cash against proper receipt or by demand draft or bankers cheque or Indian postal order payable to the PIO, Syndicate Bank. In respect of citizens who are claiming exemption for payment of the said fee as per the Act, they shall necessarily enclose proper and authentic proof stating that they belong to the Below Poverty Line category from the Authority concerned.

Fee/Charges applicable for providing Information under the Act.

The PIO is also entitled to charge additional information for providing the information as mentioned below

Rs.2/- for each page (in A-4 or A-3 size paper) created or copied
actual charge or cost price of a copy in larger size paper

Rs. 50/- per diskette or floppy
    actual cost or price for samples or models
    for inspection of records, no fee for the first hour; and a fee of Rs.5/- for each subsequent hour (or fraction thereof )
    for information provided in printed form at the price fixed for such publication or rupees two per page of photocopy for extracts from the publication.

RTI Application – Appeal provision.

If the applicant is not satisfied/aggrieved with the reply given by the PIO he can prefer an appeal before the Appellate Authority concerned within 30 days from the date of receipt of the reply. The list of Appellate Authorities is furnished below as a link. Click Here.

RTI Application – Second Appeal to the Central Information Commission

If the application is not satisfied/ aggrieved with the reply of the Appellate Authority he/she can approach the CIC within 90 days from the date of receipt of the reply. The Address of the CIC is furnished below:
